DEFINITIONS
Data Protection Law: means all applicable data protection laws, including but not limited to, UK Data Protection Act 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”), as well as any other data protection laws in and any other jurisdiction Columbus operates its business, as applicable, and any legislation which amends, extends, consolidates, re-enacts or replaces same, including any statutory instruments, regulations, codes of practice, guidelines or similar applicable to or derived from the same that may be made pursuant thereto from time to time.
Data Subject: means a natural person to whom any Personal Data pertains, or otherwise as defined in applicable Data Protection Laws.
Insurance: means insurance cover under the Policies.
Insurance Distribution Activities: shall have the meaning given to it in the FCA Rules.
Insurance Premium Tax: means Insurance Premium Tax as provided for in Part III of the Finance Act 1994 and any similar or successor tax.
Personal Data: means any personal information relating, directly or indirectly, to an identified or identifiable natural person, Data Subject or otherwise as defined in applicable Data Protection Laws.
Policy: means a policy of insurance as sold by Columbus Direct.
Premium: means the gross premium excluding Insurance Premium Tax payable in respect of a Policy.
Promotional Information: means brochures, leaflets and all other forms of advertising including information on websites used for the purpose of promoting the sale of the Policies which have been approved by Columbus Direct.
AFFILIATE PERMITTED ACTIVITIES
1. Collinson Insurance Services Limited (trading as “Columbus Direct”) appoints the Affiliate, on a non-exclusive basis, to introduce, Customers to Columbus Direct in the manner expressly stipulated in these Terms for the purpose of such Customers purchasing Insurance from Columbus Direct.
2. The Affiliate shall introduce Customers to Columbus Direct from activities that consist of:
i. the provision of Promotional Information to a Customer about:
(a) Insurance provided, advertised or arranged by Columbus Direct; or
(b) Columbus Direct and how it can be contacted,
ii. where the provider of the information does not take any step other than the provision of information to assist in the conclusion of a Policy.
3. For the avoidance of doubt, the Affiliate is not authorised by Columbus Direct:
i. to endorse or recommend the Insurance or advise upon, arrange or assist in the administration or performance of any Policy, or to collect any Premiums (including any Insurance Premium Tax);
ii. to offer credit on behalf of or bind Columbus Direct in any way;
iii. to handle, admit or settle any Claim;
iv. to provide Insurance Distribution Activities; or
v. to provide introduction services in respect of any other insurance policies or products other than the Policies, unless agreed in writing by Columbus Direct.
4. The Affiliate shall not sub-contract their obligations under the Agreement or to enter into any sub-agency agreement (or similar arrangement) to permit a third party to introduce, advise or deal in any other manner with the Policies without the prior written consent of Columbus Direct.
5. The Affiliate acknowledges that all Customer Data which it acquires in connection with this Agreement belongs to Columbus Direct and may only be used by the Affiliate for the purpose of fulfilling its obligations under this Agreement. The Affiliate shall not otherwise transfer any Customer Data to any third party without the prior written consent of Columbus Direct.
